Kidnapping Among New Charges For Saint Viator Grads: Report

Three teenagers are accused of sexually assaulting a female classmate at a graduation party last year.

ROSELLE, IL — Three recent Saint Viator High School graduates are facing new charges stemming from an accusation that they sexually assaulted a female classmate last June. The incident reportedly occurred at a graduation party in Roselle, according to the DuPage County State's Attorney's Office and the Roselle Police Department.

Kevin Niemiec, of Prospect Heights; Jon Clary II, of Bartlett; and Zachary Mascolo, of Arlington Heights, all aged 18, were arrested on multiple counts of criminal sexual assault last month. The Daily Herald is reporting the trio, who were indicted on the original charges on Jan. 6, as well as criminal sexual assault (use or threat of force), are now also being charged with criminal sexual abuse, kidnapping and unlawful restraint, according to DuPage County court records.

Roselle police said they were notified of a criminal sexual assault that had occurred at some point between June 14 and June 15 at the party. Following an investigation, police said the incident occurred when the three defendants and the victim were in a minivan, with each of the accused sexually assaulting the victim.

After the assault, the victim went to the home of a friend and contacted her sister, who in turn told their parents, according to a news release from the DuPage County State's Attorney's Office. Prosecutors said the victim's parents immediately picked up their daughter from the friend's house and brought her to a local hospital for medical attention.

Following their arrests, a judge on Dec. 23 ordered Niemiec to remain detained, but denied the state's motion to detain the other two defendants. As part of the conditions of that pre-trial release, Mascolo and Clary are not allowed to possess or consume alcohol, and also not have contact with the girl or her family.

Niemiec was arraigned Monday and pleaded not guilty, according to The Daily Herald. He will remain in jail, with his next court date scheduled for Feb. 9. The media outlet is also reporting Clary and Mascolo are scheduled to appear in court Jan. 27.
