Gas Station Thief Spits On Sergeant, Others While Resisting Arrest: Des Plaines PD
The Westchester man was charged with five felonies for the Wednesday incident at a BP Gas Station.

DES PLAINES, IL — A Westchester man is facing five felonies following a contentious arrest Wednesday at a local gas station in which police say he spit on multiple officers, including a sergeant. Marques Davis, 20, of the 10600 block of Essex Street, is accused of four felony counts of aggravated battery to a peace officer, a felony count of resisting a peace officer, as well as a misdemeanor count of the latter.
The Cook County State's Attorney's Office approved the felony charges. Davis was due in court for a detention hearing at the time of the report.
Des Plaines police responded to the BP Gas Station in the 2900 block of S. Manheim Road at 10:41 a.m. Wednesday, for a theft report. A man, later identified as Davis, was reportedly inside the gas station, arguing with employees, and eventually left with unpaid items. He had been last unseen walking northbound toward Mannheim Road, according to the employees.

When an officer arrived on the scene, a passerby stopped them and said a man was acting recklessly behind a building in the 3000 block of S. Mannheim Road. The employees said Davis had stolen a sandwich, chips and a bottle of lemonade.
Later, the officer found Davis to the east side of the building engaged in a verbal dispute with a female. While police told him to stop multiple times, the officer noted he was in possession of the stolen items from the gas station. The officer stood in front of Davis, who then threw the items and began to approach the officer aggressively, according to police. The officer put their hands out to push Davis away in order to create distance when Davis allegedly spit on them, striking the officer in the face and chest.

Davis was advised he was under arrest, and while grabbing his wrist, police said he tensed his arms and pulled away. Davis then repeatedly spit in the face of the officer and pushed them multiple times before eventually being taken into custody.
After being escorted to the patrol squad, police said Davis was advised to sit in the back seat, but herefused to do so and pushed back at officers as they attempted to seat him. During this altercation, Davis spit at the sergeant on scene, striking him in the face and vest. He was eventually taken back to the Des Plaines police station.
