Madigan Seeks 30-Day Delay on Concealed Carry

Illinois Attorney General Lisa Madigan is asking for 30 more days for the governor to review the just-passed concealed carry law.


After the Illinois legislature passed a law permitting gun owners who pass certain requirements, such as 16 hours of training, to carry concealed weapons, Attorney General Lisa Madigan sought more time for Gov. Pat Quinn to review the decision.

Madigan filed a motion on Monday with the U.S. Court of Appeals for the 7th Circuit, seeking a 30-day stay of its mandate to enact a new law governing the carrying of handguns in public, according to a statement from her office. 

Madigan issued the following statement regarding the motion filed with the Court: “The current stay of the Court’s mandate expires in less than one week, which significantly shortens the time set in the state Constitution to allow the Governor to review legislation. This request for an additional 30 days would allow the Governor a reasonable amount of time to fulfill his state constitutional duties. Further, if granted, this additional time would help prevent a situation in which there is no state law in place governing the carrying of handguns in public, which the Court sought to avoid in setting the original stay.”
