Naval Academy Head Won't Have to Recuse in Sexual Assault Case, Judge Rules

A Naval Academy superintendent won't have to recuse himself from a decision on whether or not to court-martial three midshipmen accused of a sexual assault.

The Associated Press reports U.S. District Judge Ellen Hollander said Monday in federal court in Baltimore that it would be inappropriate for her to "stick my nose in the Navy's business."

The lawsuit by the victim had put a hold on the decision by Vice Adm. Michael Miller. The victim's attorney, Susan Burke, had contended Miller was biased toward the accused midshipmen, Tra'ves Bush, Josh Tate and Eric Graham, according to the AP report.

The three are accused of sexually assaulting a female midshipman at an off-campus party last year. An Article 32 hearing in the case wrapped in September.
