Resident V. Brookline: Neighbor Files Lawsuit Against Apartment Complex

The plaintiff lives adjacent to where the building is slated to be built.

BROOKLINE, MA — A resident has filed a lawsuit against the development of a 103-apartment complex in the area of Chestnut Hill, according to a report from Brookline News.

Xiaoning Crowley has sued the town’s Zoning Board of Appeals, the Massachusetts Executive Office of Housing and Livable Communities, and developer Elias Patoucheas. The lawsuit is mainly centered around the presence of dry cleaners on the property, and that they can contaminate soil and groundwater. Also, Crowley, who owns a three-family house on 557 Heath St., is arguing that the proposed six-story structure will “dwarf” her property.

Patoucheas first proposed the project in August 2023, and was recently authorized by the ZBA.
