Downtown Framingham Restaurant/Bar May Lose Alcohol License

Police are recommending the Route 135 establishment to lose license for 5 days. Selectmen to hold public hearing tonight, Nov. 3.

Framingham Selectmen will hold a public hearing tonight, Nov. 3, to decide if a downtown Framingham restaurant and bar should lose its alcohol license.

A police investigation identified several violations at Railroad Six Sports Grill, located at 398 Waverly Street in Framingham. Framingham Police are recommending Selectmen suspend the alcohol license for 5 days.

The bartender was arrested on drug charges in July, the manager told Police he only spends 5 hours a day on site while the Town requires a minimum of 40 hours per week, and the restaurant had stopped serving food but was continuing to pour alcohol, according to a police report submitted to Selectmen, the town’s alcohol licensing agent.

On July 10, a bartender at Railroad Six Sports Grill was arrested and charged for possession of Class A drug, according to a police report submitted to Selectmen.

That bartender was the only employee at Railroad Six and he did not have a Town of Framingham Server
Identification card, according to Police.

According to Framingham Police Lt. Harry Wareham, the manager of Railroad Six Sports Grill Salvatore Bellone could not provide Town of Framingham Server Identification Cards for six additional employees, in addition to the bartender arrested.

The assistant manager listed on Railroad Six Sports Grill license James Neal, is no longer employed at Railroad Six Sports Grill, and the Town was never notified of the change, which is a violation of the alcohol license.

β€œDuring the July 16, 2015 meeting at the Police Station it was determined that Daniel Plumadore, proposed assistant manager does not have a Town of Framingham Server Identification Card,” according to a report prepared by Lt. Wareham for Selectmen. That is a violation.of the Town’s rules and regulations governing alcoholic beverages.

According to a police investigation, the manager of Railroad Six Sports Grill license, told Framingham Police he ”spends approximately five hours a day on premise. Bellone stated on his 2010 manager application that he would be spending 50 hours a week on the premises.”

The Town of Framingham requires managers to be on site a minimum of 40 hours.

Also during a health inspection in July, an employee of Railroad Six Sports Grill informed Board of Health inspector Diana Ekman that Railroad Six was no longer serving food.

During a July 16 meeting at the Police Station, the manager told Police β€œRailroad Six was in the process of
updating the menu and has not served food for six months.”

Framingham Selectmen after listening to testimony at tonight’s public hearing can accept the Police recommendation for license suspension, or they can decide or a lesser or more severe license suspension.
