100 Years Ago: A Local Court Battle

May 25, 1911: Verdict is Set Aside: Judge Quinn in Bond-Keating Case Decides in Favor of the Defendant

The verdict against George F. Bond has been set aside by the court. This suit arose out of the building of the George F. Bond block, corner of Main and Liberty streets, and was tried before a jury. Mr. Bond let the entire construction contract to Andrews & Son. Mr. Keating, the plaintiff, was a subcontractor, under Andrews for all the mason work in the building. The brick wall at the westerly end of the Bond building was constructed as a party wall, to be used jointly by Mr. Bond's building and the building of the Ancient Order of Hibernians, which was afterwards constructed. By an agreement between Mr. Bond and Hibernian Building Association, the latter reimbursed Mr. Bond for one-half the cost of the wall. Mr. Keating claimed that he was entitled to receive this money, that the Hibernians paid to Mr. Bond, as only one-half of the wall was in the Bond-Andrews contract. Mr. Bond claimed that his contract with Andrews called for the building of the entire wall, and that as he did not deal with Mr. Keating in the building contract, that he was not liable to Mr. Keating.
