Lawsuits Stall North Andover Rec Center Construction
The lawsuits — one in land court and the other in superior court — were filed by neighbors of the project.
NORTH ANDOVER, MA — Separate lawsuits filed in Massachusetts Land Court and Essex County Superior Court threaten to delay the planned start of construction for a recreation complex between Atkinson and North Andover Middle schools. The Land Court denied a motion to dismiss the lawsuit challenging the planning board's approval of a special permit for the project. The superior court case is challenging the town's use $6 million in money from the North Andover Community Preservation fund to pay for the project.
The town is waiting for a judges ruling on the town's motion to dismiss the superior court case, according to the Eagle Tribune, which first reported this story. The total project cost is $8.75 million.
