Roslindale Man Arrested for Violating Restraining Order

A Roslindale man was arrested for violating a restraining order, even though the victim, had invited him over.

On April 29, around 7:32 p.m., Maksim Zylyftari, of 17 Hewlett St. #2, Roslindale, was arrested and charged with violating a restraining order issued on April 22, 2013 out of West Roxbury District Court, according to a Boston Police report. The restraining order was to remain in effect until May 6, 2013 at 2 p.m.

Boston Police officers had paperwork to serve the suspect, Zylyftari, with a restraining order, and then saw he had been served on April 23. Unsure if he had been served, they decided to go to the address to confirm he had been served. Officers spoke with the victim, who said the suspect, was in the home playing with their daughter, according to a Boston Police report. Officers asked her to have her husband come to the hallway to speak to him.

The suspect said he had been served the restraining order, but that his wife had called him earlier to try to work things things out. Officers then advised the victim she should not contact the suspect because of the active restraining order.

Based upon the circumstances presented to them, the officers arrested the suspect for violating a restraining order. The officers explained to the suspect and victim that they were mandated by Massachusetts law to arrest the suspect.

Officers advised the couple to go back to court to vacate the restraining order, if that's what she wanted, according to a Boston Police report.
