Burnsville Man Charged with Masturbating in Public Turns Himself In

Police say Anthony Wayne Smith exposed himself to a man and his daughter in May.

A Burnsville man being sought by police for masturbating in front of a man and his daughter in May was arrested Monday.  

Anthony Wayne Smith, 25, is charged with fifth-degree criminal sexual conduct, a gross misdemeanor with a maximum penalty of a year in jail and a $3,000 fine. 

Police say he approached a Burnsville man and his young daughter on May 9 while the two were outside playing basketball. Smith was wearing only bicycle shorts and had his hand inside his pants, masturbating, according to the criminal complaint.

Smith apologized to the man while they waited for police to arrive, explaining that he was “in heat,” a claim that he repeated to officers on the way to jail.

Smith turned himself in to authorities Monday morning and remains in the Dakota County Jail. He is scheduled to make a first appearance on the charge Tuesday in Dakota County District Court in Hastings.
