Man Charged with Threatening Woman After Car Gets Towed

Cary James Fultz is accused of threatening to kill a woman at a Burnsville apartment complex, and smashing her cell phone when she tried to call for help.

A Burnsville man has been charged with threatening to kill a woman, smashing her cell phone and biting her on the hand after the two argued about his car being towed.

Cary James Fultz, 23, is charged with making terroristic threats, a felony with a maximum penalty of five years in prison and a $10,000 fine. He is also charged with interfering with a 911 call, a gross misdemeanor with a maximum penalty of a year in jail and a $3,000 fine.

Fultz remains in the Dakota County Jail on a $30,000 bond. An omnibus hearing in his case is scheduled May 15 in Dakota County District Court in Hastings.

According to the criminal complaint, police were called to a Burnsville home April 28 on a report of a domestic assault.

Officers spoke to the victim, who said she and Fultz had argued about his car being towed. She said Fultz had been drinking and began yelling at her.

At one point, the victim told police, Fultz threatened to kill her, grabbed her and threw her into a wall, causing her to hit her head.

When the victim tried to call 911, Fultz snatched her phone from her hand and threw it into the hall, where it broke into pieces, she said. At some point during the altercation, Fultz bit the victim on the hand, according to the complaint.

When she tried to leave, Fultz grabbed her and wrapped his arm around her neck, choking her, the victim said. She managed to get away and went to another apartment, where she called police.

Police spoke to a witness, who said Fultz was “out of control” and he thought Fultz was going to kill the woman, according to the complaint.

Officers found the shattered cell phone in the apartment hallway about three doors down from the victim’s apartment.
