Bad Faith Insurance Claims: What To Do If an Insurer Denies a Valid Claim or Delays the Settlement Process

An insurance company can be held liable for the damages caused by their policyholder in an accident. This includes covering medical costs, lost wages, and property damage, up to the policy limits. The insurance company may face additional liability for punitive damages if the conduct of the policyholder was especially reckless.

In some cases, however, the insurer may be acting in bad faith by denying a valid claim or unduly delaying the settlement process. Unreasonable delays, unjustified denials, or lowball settlements are common signs that you may be dealing with a bad faith insurer. Other bad faith tactics include failure to conduct a proper investigation, promoting internal policies that encourage claim denials, or constantly changing your adjuster which ends up causing confusion and further delays. There are times when insurers engage in refusing or delaying medical treatment as another bad faith tactic. This can make it harder to prove your injuries are connected to the accident, and insurance companies can use this to their advantage. If you cannot prove that your injuries were caused by the accident, insurers may minimize or even deny your claim.

If it is found that an insurance company acted in bad faith when addressing your claim, you may be entitled to additional compensation because of it. The insured may be entitled to the original policy benefits, plus consequential damages like extra loans or business losses, and potentially be compensated for emotional distress. Compensation may also take shape as a settlement offer to resolve a liability claim for the full amount of the insured's policy. This is called a Time-Limit Demand, as it is executed under the condition that the offer must be accepted within a specific timeframe. These demands put pressure on the insurer to accept within a short period, often in cases with clear liability and significant damages, to avoid the risk of an excess judgment against their policyholder.

When it is deemed appropriate, courts can award punitive damages to punish the insurer and recover legal fees and court costs. In certain situations, the insurer may be held liable for the full amount of a judgment, which can exceed the policy's limits.
