How Long is Too Late to Wait to Pursue a Lawsuit in an Accident Case?

Attorney Sam Ryan Heidari shares his knowledge as part of his new information campaign to help the public.

Las Vegas, Nevada – /News Reported by LaGuardia Media and Public Relations/ – In keeping with their efforts to educate citizens of their options in case of an accident, Sam Ryan Heidari and Heidari Law Group are sharing their knowledge on the statute of limitations that affect personal injury cases.

Residents may not be aware that even though an accident may have happened, say, six months ago, they still may be entitled to compensation from those at fault. States like California, Nevada, and Texas all have a two-year statute of limitations on personal injury accident cases, meaning one has up to two years to file suit. Not many people are aware of this.
Types of Nevada Car Accident Claims and Time Limits

Although statutes of limitation exist, there are exceptions to those rules, or times when a statute of limitations can be “paused”. This is a process called tolling. This is usually possible only under special circumstances, such as when the plaintiff is a minor, or under the “discovery rule”, mostly applied for things such as delayed injuries, etc.

In a car accident, “tolling” refers to the legal principle of pausing or suspending the statute of limitations, or the deadline for filing a lawsuit. Circumstances like the injured party suffering a severe physical or mental disability, as well as military service, can trigger tolling. Additionally, the parties involved can enter into a formal “tolling agreement” to pause the deadline, giving them more time to negotiate a settlement.

Protections Offered from Legal Tolling

  • Protects Rights: Tolling protects the rights of vulnerable parties, like minors, who lack the legal capacity to protect themselves.
  • Promotes Settlement: Tolling agreements encourage settlement by providing more time for negotiations and exploration of resolution options outside of court.
  • Avoids Dismissal: Tolling helps prevent a lawsuit from being dismissed simply because the filing deadline passed, especially if the delay was due to factors beyond the plaintiff's control.

Due to the intricacies of these cases (such as the ones mentioned above), having a qualified personal injury lawyer on your side to help you navigate all of your options is of the utmost importance.
