Economic damages are awarded when there are quantifiable losses for which the plaintiff is entitled compensation; medical bills, lost wages, etc. This may also include childcare expenses, travel expenses as they relate to medical treatment, and vehicle replacement or repair.
Non-economic damages are awarded when the actions of the responsible party caused the plaintiff to endure intangible losses; pain and suffering, emotional distress, etc.
Punitive damages are awarded when the actions of the responsible individual were malicious, oppressive, or done with a reckless disregard for the plaintiff's rights and safety. Also, there must be a direct link between the defendant's actions and the plaintiff’s injury or loss. If these two main conditions are met, there is a good chance that you would be entitled to punitive damages.
Identity theft and fraud, assault and battery, DUI accidents, and institutional elder abuse (nursing homes) all qualify for damages, depending on the details of the case. Also included may be accidents that cause permanent disability, diminishing quality of life, and
