Judge Upholds Charges, Rejects Defense That Gaudreau Brothers' Drinking Contributed To Their Deaths

A judge rejected the defense's argument Tuesday that the Gaudreau brothers' drinking contributed to their deaths when an allegedly drunken and enraged driver fatally struck them as they cycled in Salem County, New Jersey, the night before their sisters' wedding in August 2024.

After nearly two hours of argument as the family of Johnny Gaudreau and his brother Matthew listened in pain, Superior Court Judge Michael Silvanio agreed the issue was moot under state law, upholding all of the charges against the driver, including manslaughter and vehicular homicide.

"There's no credence in the argument there was contributory negligence on the part of the cyclists," Silvanio said.
