Appeals Court Throws Out $3 Million Judgement Against City

Biker sued Newark after being seriously hurt in an accident in 2007

An appeals court Thursday reversed a $3 million judgement awarded to a motorcyclist injured on a Newark street six years ago, NJ.com reported.

Paul Roura was riding in the Ironbound June 30, 2007, when he slid after  swerving to avoid a pothole. Roura sued the city, and in 2011 a jury awarded him $700,000 for medical expenses along with $2.3 million for pain and suffering.

The city appealed, however, describing the judgement as a “miscarriage of justice,” NJ.com reported.

In ruling to overturn the decision, the appeals court panel Thursday cited numerous procedural errors by Essex County Superior Court Judge Torkwase Sekou, including failing to disallow remarks made by Roura’s attorney that were “not relevant.”

It was unclear if Roura’s attorneys would attempt to revive the lawsuit, NJ.com also reported.
