Board of Adjustment to Hear Hekemian Application for United Water Property

Hekemian seeks variances from Board of Adjustment to develop United Water property

The Planning Board's denial of a developer's application asking for  moves the approval process to the Board of Adjustment Tuesday at 7:30 p.m. in the Council Chambers of Borough Hall. The meeting is open to the public. 

, submitted to the Building Department by New Milford Redevelopment Associates LLC, whose managing director is Peter Hekemian, Principal and V.P. of Development for the S. Hekemian Group, call for a four-story 221 unit multi-family housing complex that includes an affordable housing component; a 428-space multi-level parking garage and a pool; a 70,500 sq. ft. supermarket; and a 4300 sq. ft. bank with two drive-thru lanes. 

The on the grounds that Hekemian needed a "D" variance, which is required when an applicant seeks a change in land use and if the proposed height of the buildings exceed the town's requirements. In the case of the United Water property, Hekemian is seeking to have the use changed from residential to mixed-use.

The Board of Adjustment always hears site plan applications that require "D" variances. 

In order for Hekemian's site plan application to be approved as it is filed, he must seek approval from the Board of Adjustment for a change in the zoning from residential to mix-use and these five variances:
