During the stop, authorities smelled alcohol on the breath of the driver, identified as Marion Polo, 36, of Parsippany, and spotted a bottle of vodka on the car’s floor, police said. He failed sobriety testing and refused a breathalyzer, officials added.

Police also found a black Sig Sauer handgun on the floor of the vehicle. Polo did not have a firearms identification card and was prohibited from carrying or owning a weapon, police said.

Polo was brought to the Fairfield Police Department for processing and charged with possession of a weapon for an unlawful purpose, unlawful possession of a weapon, certain people not to have weapons, driving while intoxicated, refusal to submit to breath testing, having an open container of alcohol in the vehicle, and several other motor vehicle charges.

He also had a warrant for his arrest out of Caldwell, NJ. Polo’s vehicle was impounded and is pending a search warrant.
