Council Advances Two Major PILOT Agreements Amid Growing Public Opposition

On Tuesday, December 2, the Parsippany-Troy Hills Township Council advanced two separate PILOT (Payment in Lieu of Taxes) agreements, approving both ordinances on first reading despite clear indications that large numbers of residents intend to oppose the projects at their final hearings.

The first ordinance concerns a tax-exemption agreement with PARQ Urban Renewal, LLC, approved by a 4–1 vote, with Councilman Matt McGraft voting against the measure. ORDINANCE 2025:31

This whole PILOT deal giveaways to corporate real estate is getting strang. Councilwoman Hernandez seems to crossed over from her former opposition, as she Councilman Musella, and McGraft (previously abstained) opposed. There seems to be some non transparent behind the scenes contact ambiguity in this poorly made Housing Deal. This occurs when a contract term or phrase that seemed clear when the deal was struck, appears anything but when litigants later disagree as to their respective rights and obligations. We must ask who made the deal, did the Mayor's Office know the intricacies?

Council was held hostage; given no information prior that this. that the developer could just walk away leaving us vulnerable, and that a PILOT was non negotiable for the developer that chose to be in our housing plan. Council was not privy to any details until about 10 days ago. Council did not understand the legal ramifications they were not part of negotiations until we were forced at the last minute. So we agreed to the New Housing the PILOT was non transparent.

Ramifications?
If this is true, it appears to be an extortion racket by the corporate real estate developer, and lack of due diligence by Parsippany Mayor's Office, and most likely not including the housing council itself. It is the Mayor's Office that establishes local goals for affordable housing and community development, including what types of projects are needed.

This situation in my opinion demands a "Stedfast No Vote" not caving in to a sleazy non transparent deal using Housing as a fear and extortion tactic. This project has "minimum" affordable requirements not call for a tax exemption PILOT. There are other arrangements that would perhaps warrant some PILOT, for example more affordable units; minimum 50 for example.

Other aspects that have become lost or non transparent are; what is Parsippany's and all surrounding communities "regional contribution" verses it local obligations, or has that aspect been erased in the "developers remedy"? How do the numbers mount before the developers stop, and simply lower the rents regionally, as in make affordable?

Parsippany has made itself an outlier in this Housing Fiasco, in that the "rateable chase" has brought our town to be over developed, in need of redevelopment. What else can become these corporate properties in a market system?

Notify the State Attorney General No Surrender!
It is difficult to understand how Parsippany can stand to be sued, for rejecting this new found Hidden PILOT's fine print.
Council should not surrender. In my opinion more truly affordable units must be forthcoming maximum low income, and the Office of the State Attorney General be brought into this.

Parsippany has many housing possibilities non of which are being looked into or implemented. Hiawatha for example, a once small home community has fallen to its character change with large more expensive homes being built among the former cabin, and cape cod homes.

The only alternative if all this is true about the PILOT here before us, this deal or contract must be brought to Rescission; dissolving a contract because of misunderstandings, misrepresentation, mistake, duress, or undue influence.

This whole episode of PILOTs is a form of gangster capitalism that is inflicting our nation, property, corporate real estate has become the enemy of community, and nature itself. Housing should be like Healthcare a "basic passive right of citizenship"

Endless growth is impossible in a finite would. This Mount Laurel Law has been totally misused and applied as a fear tactic by corporate real estate finance in a market will bare economy will not fantasy. It has become a Metastasis, a cancer spreading, the only cure the morality within the law to remedy.

Affordable Means affordable, the more privatized we become the less free we are. The more Centralized our society becomes in matters of health, wellbeing, and basic passive rights of shelter, health, education, we all become stronger on every level. We are a house divided too pluralistic. Our Federal Power has lead us down, as housing is one of many rights that lack subsidies from that power.

Finally Council is in a Lame Duck Session
Dangers of lame-duck sessions are the decreased accountability of lawmakers and the potential for rushed, controversial legislation to be passed. This can also lead to decisions that benefit special interests. Was this deliberate to somehow tarnish the incoming elected? How short our memories are. Failed Republic where are "we the people" in all this?

A huge part of the problem is the Jeffersonian notion that" the government that governs best is the one that governs least". While it is true as regards individual liberties, it is absolutely dangerous to think that way as regards economy...

Ideas of small government are not in keeping with the times and circumstances we face, as a people and a Planet in these times..We need good government now more than ever as the means proper.

Never in the history of democratic societies has the populace been more removed from the decision making process than it is today. Our Collective Global future is being made behind closed doors by trade representatives-appointed officials with the blessing of amorphous, transnational corporations.
