Bergen County Prosecutor Mark Musella announced the arrest of MIKULAS BANACKY (DOB: 11/17/1949; married; unemployed) of Garfield, New Jersey on charges of child endangerment and aggravated criminal sexual contact. The arrest was a result of an investigation conducted by the Bergen County Prosecutor’s Office under the direction of Chief Jason Love and the Garfield Police Department under the direction of Chief Raymond Kovach.

On Tuesday, July 27, 2021, the Division of Child Protection & Permanency contacted the Bergen County Prosecutor’s Office Special Victims Unit regarding an accusation that MIKULAS BANACKY engaged in inappropriate sexual conduct with a child under the age of sixteen while in Garfield, New Jersey. An investigation was initiated by the Bergen County Prosecutor’s Office Special Victims Unit and the Garfield Police Department.

As a result of the investigation, on Tuesday, August 17, 2021, MIKULAS BANACKY was charged with one count of second-degree endangering the welfare of a child, N.J.S.A. 2C:24-4a(1); and one count of third-degree aggravated criminal sexual contact, N.J.S.A. 2C:14-3a. BANACKY was transported to the Bergen County Jail pending his first appearance in Central Judicial Processing Court.

Prosecutor Musella states that the charges are merely accusations and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.
