Home Health Aide Arrested After Shaking 96-Year-Old Fall Victim’s Leg: Police

The incident occurred at 6 p.m. Friday, police say.

LAWRENCE, NY. — An in-home health aide was arrested after she was caught on camera shaking the injured leg of the 96-year-old woman she cares for — while the woman was on the ground after a fall, police said.

According to Nassau County police, Marie Byron, 65, was arrested Monday and charged with one count of first-degree endangering the welfare of an elderly/incompetent/physically disabled person and one count of second-degree endangering the welfare of an incompetent physically disabled person.

The 96-year-old’s nighttime health aide showed up to work Friday night to find her patient complaining of leg pain, with a laceration on her body that hadn’t been there the night before, police said.

The nighttime aide then called the woman’s legal guardian and 911, at which point the 96-year-old woman was hospitalized and treated for a broken femur, police said.

The legal guardian watched security camera footage from inside the home, which showed the elderly woman falling, police said. After the fall, the security footage showed Byron grabbing the woman’s leg and shaking it aggressively, causing extreme pain to the woman, police said. Byron did not call 911 or seek appropriate medical attention for the woman, police said.

Her arraignment was scheduled for Monday.
