Glen Head Man Convicted Of DWI Despite Refusing Breath Test

BREAKING: The man swerved into oncoming traffic while driving double the speed limit in Roslyn Heights in March 2016, the DA says.

A Glen Head man was found guilty of operating a motor vehicle while intoxicated despite refusing a breath test in March 2016, Nassau County District Attorney Madeline Singas announced.

According to the DA, Kevin Kralick, 37, faces up to 1 1/3 to four years in prison.

The DA says Kralick was driving a 2013 Suburban northbound on Bryant Avenue in Roslyn Heights when police officers noticed he was failing to maintain his lane and driving 60 miles an hour in a 30 miles per hour zone on March 23, 2016. Kralick's vehicle was seen crossing into oncoming traffic and repeatedly swerving over the double yellow line, the DA says.

Officers pulled over Kralick and observed that he was intoxicated; he was swaying while standing, had a strong smell of alcohol on his breath, glassy eyes and slurred speech, the DA says.

He was arrested after refusing a preliminary breath test on the scene and later refused a second breath test at police headquarters while in custody, the DA says.

“[Kralick] endangered every driver and pedestrian when he drove drunk through Roslyn swerving out of his lane at twice the legal speed limit," Singas said in a press release.

The trial lasted nine days and the jury deliberated for approximately 40 minutes. Kralick is due back for sentencing on September 25.
