Freeport Man Accused Of Driving Drunk With 3-Year-Old Son: Police
He hit a curb so hard he broke the car, police said.

ROOSEVELT, NY — A Freeport man who smashed his car into a curb so hard that the Honda Civic was rendered inoperable now faces charges of DWI and violation of Leandra's law after driving with his toddler in the vehicle, police said.
Police said Abidan Sorto-Benitez, 32, was at the intersection of Branch Place and Conlon Road where he struck a curb, rendering his vehicle inoperable at 9:50 p.m. Saturday.
Responding officers said he showed signs of intoxication, including glassy eyes and the
smell of alcohol emanating from his breath.

Officers conducted a standardized feld sobriety test with positive results, after which Sorto-Benitez was placed under arrest without incident, police said.
His son, 3, who was a passenger in the vehicle, was released into the custody of a family member, police said. No injuries were reported.

Sorto-Benitez was arrested and charged with aggravated driving while intoxicated (child under 16) under Leandra’s law; endangering the welfare of a child, driving while intoxicated, aggravated driving while intoxicated and multiple vehicle and traffic infractions, police said.
He was scheduled to be arraigned on Sunday at First District Court in Hempstead.
