Troopers learned that Mallon had unlawfully entered the unused facility by crawling through a hole in the perimeter fence. He told state police that he wanted to take photos inside the facility, but became trapped in a cell.

With the help of the Glenham Fire Department, troopers helped Mallon out of the cell, and then arrested him. He was charged with misdemeanor third-degree criminal trespass, with a scheduled appearance date in the Town of Fishkill Court.
