Trump Asks Supreme Court To Block Hush Money Case Sentencing

Defense lawyers previously said that Trump couldn't be sentenced because, as president-elect, he enjoys the same immunity as a president.

NEW YORK CITY — President-elect Donald Trump has asked the Supreme Court to block his upcoming hush money case sentencing scheduled for Friday.

"This Court should enter an immediate stay of further proceedings in the New York trial court to prevent grave injustice and harm to the institution of the Presidency and the operations of the federal government," Trump's defense lawyers wrote in a court filing.

The court on Wednesday asked New York prosecutors to respond to Trump's request by Thursday morning, giving the justices enough time to come to a decision before Friday's sentencing, according to an NBC News report.

Defense lawyer Todd Blanche previously said that Trump couldn't be sentenced because, as president-elect, he enjoys the same immunity from criminal proceedings as a president.

Judge Ellen Gesmer denied a request for an immediate order that would let Trump avoid sentencing.

The sentencing date would come days before the scheduled presidential inauguration on Jan. 20.

Trump had been scheduled to be sentenced on Nov. 26 after he was convicted on 34 felony counts related to hush money payments made to adult film actress Stormy Daniels, Patch previously reported.

While Trump will be sentenced, Merchan disclosed he wouldn't order Trump to be jailed.
