Updated Fines & Penalties For Town Code Violations

Following a public hearing on Tuesday, the Clarkstown Town Board adopted a new schedule of fines and jail terms for violations of 24 chapters of the town code. Originally, town officials said 26 chapters would be updated and then revised that number to 24. Code & Zoning Enforcement Officer Joel Epstein provided the comparison list of previous and updated penalties.  

Chapter 93, Alcoholic Beverages

Former: Up to $250 + 15 days.
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500 

Chapter 109, Building Construction Administration

Former: Up to $1000 + 1 year in jail      
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000

Chapter 112, Graffiti

Former: Up to $500       
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000

Chapter 125, Dogs & Other Animals

Former: Up to $1000     
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000 

Chapter 126, Massage Establishments

Former: $500-$2500, 2nd: $2500-5000         
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000

Chapter 136, Explosives

Former: Up to $500 + 15 days.
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500

Chapter 149, Garbage, Rubbish & Refuse

Former: Consumer: up to $500, Carter: 1st=$500-1000, 2nd=1000-2000, 3rd=3000-5000
New: Consumer: up to $2500, Carter: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000 

Chapter 173, Littering & Posting

Former: Up to $1000 + 15 days 
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000

Chapter 180, Memorial Day Activities

Former: up to $250 + 15 days
New: up to $2500 

Chapter 200, Parking

Former: $50, 100, 250
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500

Chapter 202, Parks & Recreation Facilities

Former: up to $50 + 15 days &/or loss of privileges
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500

Chapter 205, Noise 

Former: up to $500 + 15 days  
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000

Chapter 208, Peddling 

Former: $100-500 + 15 days  
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000

Chapter 216, Maintenance of Property

Former: 1st=$500 + 15 days, 2nd=$1500 + 6 months
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000, 4th 10G-15G

Chapter 220, Quarrying and Blasting

Former: Up to $500 + 3 months. 
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500

Chapter 236, Sewers

Former: up to $500
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500

Chapter 239, Shopping Carts

Former: up to 250 + 15 days.
New: 1^st=1000, 2^nd=2500-5000, 3^rd=5000-7500

Chapter 244, Sign Contractors, Licensing of

Former: $100-500
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500, 4^th=10,000-15,000

Chapter 248, Solid Waste Transportation and Disposal

Former: up to $1000 + 15 days.
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500, 4^th=10000-15000

Chapter 250, Streets & Sidewalks 

Former: Contractors: Up to $1000 + 15 days, Consumers: up to $250 + 15 days
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000

Chapter 258, Swimming Pools

Former: up to $1000 + 15 days
New: 1^st=$1000, 2^nd=2500-5000, 3^rd=5000-7500

Chapter 270, Tree Preservation

Former: $500-1500 + 30 days,
New: 1^st= $1000, 2^nd=2500-5000, 3^rd=5000-7500

Chapter 278, Vehicles and Traffic

Former: 50-100-250 (traffic infraction)
New: 1^st= $250 + 15 days, 2^nd=1000 + 15 days, 3^rd=2500 + 15days

Former: 1st: $350 + 6 months, 2nd: 350-700 + 6 months, 3rd: 700-1000 + 6 months
New: 1st Offense: Up to $2500, 2nd: 2500-5000, 3rd: 7500-10,000, 4th: 10,000-15,000
