Charges Dropped In Fatal Teen Stabbing On Park Slope Subway: Report
A grand jury found Mark Smith, 26, acted in self-defense when he stabbed Isaiah Collazo, 18, on a D train in April, according to reports.

PARK SLOPE, BROOKLYN — A man acted in self-defense when he killed a teen straphanger as a subway train rolled into Atlantic Avenue-Barclays station, according to reports detailing a grand jury's finding.
A grand jury Tuesday effectively dropped charges against Mark Smith, 24, who stabbed Isaiah Collazo, 18, onboard a D train, the New York Daily News first reported.
Collazo's mother Iveless Martinez told the Daily News the grand jury's finding was unfair.

"He's getting away with murder," Martinez said of Smith, according to the Daily News.
The lethal encounter between Smith and Collazo unfolded late April 6 and had been sparked by what a high-ranking NYPD officials called a "stupid kid prank."

The prank in question was reportedly one of Collazo's friends pulling the emergency brake on the train, which led to an argument. Smith told the New York Post that six or seven people had jumped him on the train and he didn't intend to kill Collazo.
"The facts of this case never inculpated Mr. Smith, and this outcome is consistent with his role in the incident and the law," Martha Lineberger, a staff attorney at the Legal Aid Society which represented Smith, said in a statement reported by the Daily News.
