Holtsville Man Gets Max Sentence In Cop-Dragging Incident

He will serve up to four years in prison.

The Holtsville who dragged a police officer with his car at a traffic stop was sentenced to the maximum 1 1/3 to 4 years in prison for driving while intoxicated, officials said.

Micahel Shear, 35, was originally charged with first-degree assault and faced 25 years in prison for dragging the police officer who stopped him. A jury acquitted Shear of those charges in October.

Shear was pulled over for suspicion of drunk driving near Waverly Avenue in Patchogue last January, and fled fled the scene, dragging the officer.

After a three-mile chase, Shear was stopped and was shot by one of the officers when he refused to comply with the officer's commands and resisted arrest, police said.

Shear refused a blood alcohol test, but Suffolk County crime lab testing of his blood acquired via a warrant showed Shear had blood alcohol content of .22; nearly three times the legal limit, the DA said.
