Brian Laundrie Family Attorney Seeks Texts, Calls From Gabby Petito's Family

The request is part of the ongoing discovery process for the wrongful death lawsuit, attorney Steven Bertolino said.

LONG ISLAND, NY — An attorney for the family of Brian Laundrie has requested a record of phone calls and texts from the family of Gabby Petito in the ongoing information gathering as part of the wrongful death lawsuit filed in Florida.

Steven Bertolino told Patch that "the most recent document requests and those about to be served on the plaintiffs are all part of normal discovery process."

"The plaintiffs will have to provide the information just like any other party making claims in a legal proceeding," he said.

The documentation requests have been made by both his attorneys and Matthew Luka, who represents Brian Laundrie's parents, Christopher and Roberta Laundrie, Bertolino said.

Petito was found strangled to death in a Wyoming park in September 2021. Laundrie's remains were found about a month later in a Florida swamp, after the FBI said he wrote a confession in a notebook, saying that he killed her because she was in so much pain from a fall into a ravine.

Petito's family sued Laundrie's estate and was later awarded $3 million.

The latest legal development is part of the wrongful death lawsuit in which Bertolino has been added. Bertolino represented the Laundries in the days after Petito's disappearance.

Pat Reilly, who is representing Petito's family, declined comment.

Reilly recently sought a subpoena for the Laundrie's to provide bank account withdrawal information from around the time of Petito's slaying.
