Suffolk Man Was Drunk With Kid In SUV During Crash: Police

His Honda CRV crashed into a sedan Friday when he had his four-year-old in the car, Suffolk police said.

NORTH BELLPORT, NY — A man was under the influence of alcohol and had his four-year-old in his SUV when it crashed into a sedan in North Bellport on Friday afternoon, Suffolk police said.

Arturo Loboss was driving a 2020 Honda CRV on Station Road, when it struck a 2004 Mercury at around 2:25 p.m., police said, adding that when officers arrived, they determined Loboss was showing signs of intoxication.

Fifth Precinct officers tried to arrest Loboss, but he resisted them before he was taken to Long Island Community Hospital in East Patchogue for treatment of non-life-threatening injuries, police said.

The child in his SUV did not require medical attention and was released to a family member at the scene, according to police.

Loboss, 35, was charged with aggravated driving while intoxicated with a child passenger 15 years old or younger under Leandra’s Law, driving while intoxicated, acting in a manner injurious to a child, and resisting arrest.

Leandra’s Law, which is also known as the Child Passenger Protection Act, is a state law making it an automatic felony on the first offense to drive drunk with a person age 15 or younger inside the vehicle.

It’s named for 11-year-old Leandra Rosado who was killed on the Henry Hudson Parkway on October 11, 2009, when she was the passenger in a car accident involving drunk driving.

The sedan's driver, a 37-year-old Bellport woman, was not injured. Loboss' Honda was impounded. He will be arraigned at First District Court in Central Islip on a later date.
