5-Year-Old In The Car When Driver Arrested For DWI On I-287: NYSP
The Bronx man is now facing a felony "Leandra's Law" charge for the first offense DWI, according to New York State Police.

GREENBURGH, NY — A Bronx man was arrested in Westchester County for potentially putting the life of a small child at risk, according to state police.
On July 5, around 2:33 a.m., troopers from SP Tarrytown stopped a 2024 white Honda traveling east on I-287, in the town of Greenburgh, for moving from its lane unsafely.
The driver, identified as 34-year-old John Ariel Pena, exhibited signs of intoxication while being interviewed, according to police. Standardized field sobriety tests were administered, which Pena failed, NYSP said.

Troopers say a 5-year-old child was in the car at the time.
Pena was arrested and taken to SP Tarrytown for processing, where he provided a breath sample with a BAC of .10 percent, according to police.

Pena was charged with operating a motor vehicle with a BAC of 0.08 percent or higher as a first offense, aggravated DWI (Leandra's Law) with a child passenger under 16 (a class E felony), driving while intoxicated as a first offense, and traffic violations.
Pena is due to appear in the Greenburgh Town Court on July 25.
