New Years Day DWI Felony Arrest

A 23-year-old New Jersey man was arrested for aggravated DWI on Jan. 1. He was stopped on Walgrove Avenue after an officer allegedly observed him crossing the double yellow line twice on Bellwood Avenue around 1:51 p.m.

As the officer followed him, he observed the Passaic, New Jersey resident’s 2007 Toyota Corolla traveling at a speed of 25 mph in a 25 mph speeding zone. 

The officer allegedly smelled alcohol when he approached the car and asked the 23-year-old to take several field sobriety tests, which allegedly indicated that he was intoxicated. A breath test later revealed that his blood alcohol level was above .18 percent when the legal BAC is .08 percent.

Yunior Payano-Pena was charged with a class E felony and was released to his father-in-law on his own recognizance. He is expected to return to court on Jan. 17.
