Police: Woman Arrested for DWI With Son in the Vehicle
A Smithtown woman is facing Aggravated Driving While Intoxicated with a Child and Endangering the Welfare of a Child charges after being arrested Wednesday night, according to police.
A Smithtown woman was arrested Wednesday night for driving while intoxicated with her 10-year-old son in the vehicle, according to the Suffolk County Police Department's Fourth Precinct.
According to police, officers responded to a 911 tip at roughly 9:45 p.m. and stopped Brenda Lally, 44, who was travelling westbound on Fifty Acre Road near Linder Place in a 2010 Toyota. Officers arrested Lally after they interviewed her and determined she was intoxicated. Police said Lally’s 10-year-old son was unharmed and released to a family friend.
According to police, Lally was charged with Aggravated Driving While Intoxicated with a Child, which is a felony under Leandra’s Law, and Endangering the Welfare of a Child.

Police said Lally was held overnight and will be arraigned at First District Court in Central Islip Thursday.
