Driver Who Was Going 101 MPH On I-87 With Child In SUV Had BAC Of 0.13: Police

The 40-year-old Bronx woman faces a felony "Leandra's Law" charge, as well as speeding and other traffic violations.

CLARKSTOWN, NY — A recklessly speeding driver had a child in her car when she was pulled over and arrested on a felony DWI charge, according to New York State Police.

Troopers from State Police Tarrytown arrested Nathalie DeOliveira for driving while intoxicated with a child passenger less than 16 (DWI Leandra's Law).

State police say they stopped the 40-year-old Bronx woman on I-87 south in Clarkstown on October 18, at 11:37 p.m., after seeing her 2019 Honda SUV traveling 101 mph in a 55 mph zone and drifting into the right lane, nearly striking another vehicle. Troopers say there were signs of alcohol impairment evident when speaking with the driver.

DeOliveira submitted to a standardized field sobriety test and preliminary breath test, both of which returned positive results for alcohol impairment, according to NYSP. Police say a child under the age of 16 was in the back of the vehicle.

DeOliveira was arrested for DWI Leandra's Law and taken to State Police barracks in Tarrytown for processing, where she provided a breath sample that recorded a blood alcohol concentration (BAC) of 0.13 percent.

In addition to the DWI Leandra's Law, DeOliveira was charged with speeding and other vehicle and traffic law violations, police said.

DeOliveira was released to a sober third party and is due in Clarkstown Town Court on Nov. 10.
