Yorktown Man Has Three Pending DWI Charges

The 64-year-old Yorktown man appeared in Briarcliff Manor Court this week after he was arrested on a warrant.

A man with three pending DWI charges appeared in Briarcliff Manor Court Wednesday after he was arrested on an outstanding warrant.

Bernard D. Kelly of Yorktown was incarcerated at the time of his appearance in the village, where he is charged with a felony DWI charge, along with Driving While Ability Impaired and Aggravated Unlicensed Operation in the Third Degree.

Jail records showed Kelly, 64, also has DWI, felony DWI, Aggravated Unlicensed Operation in the Second Degree and Unlicensed Operation in the First Degree charges pending in Yorktown, stemming from two separate arrests.

Kelly was arrested on the afternoon of Feb. 20 after allegedly driving through a red light. His license was suspended due to previous alcohol-related offenses, Yorktown police reported.

After Kelly was picked up on a bench warrant out of Briarcliff Manor on April 25, no bail had been set, his court-appointed stand-in attorney said.

During Wednesday's court proceedings, Westchester County Assistant District Attorney Adrienne Chapoulie noted Kelly will likely be offering an SCI felony hearing in Yorktown.

The offer in Briarcliff Manor, she said, currently is one-year incarceration and a one-year conditional discharge, with a one-year mandatory ignition interlock device.

Kelly's stand-in attorney, appearing beside him in lieu of his assigned counsel, noted his pre-sentence report from probation recommended he be sentenced to probation.

The case in Briarcliff Manor was adjourned to May 22 and the warrant was vacated by Village Justice Howard T. Code. Instead, Code set bail at $500 cash or $1,000 bond. Each of the Yorktown cases also had $500 bail set.
