U.S. District Court Judge Remands Cheltenham Suit Against Engineering Firm To State Court

Cheltenham Township is suing Boucher & James over claims that it was improperly overbilled for engineering work.

MONTGOMERY COUNTY, PA — A federal judge in Philadelphia has sent back to state court a civil suit initiated by Cheltenham Township against an engineering firm that the municipality says overbilled it and other clients.

Cheltenham is suing Boucher & James, Inc. Consulting Engineers and other defendants over claims of improper billing.

U.S. District Judge Karen Spencer Marston, in a Nov. 9 ruling, ordered that the case be transferred back to the Montgomery County Court of Common Pleas, according to the civil docket sheet in the case.

The suit had originally been filed in state court but was later removed to the U.S. District Court for the Eastern District of Pennsylvania.

In addition to the civil component, there was also a criminal case playing out against the engineering firm.

Patch reported late last year about the Pennsylvania Attorney General's Office announcing the arrest of former Boucher & James company executives in connection with charging municipalities for work that was never performed.
