Baby Smothering Case Proceeds In Montco With Not Guilty Plea: Reports

TRAPPE, PA — A local man facing allegations that he caused his infant son's death earlier this year after forcibly placing the child face down on a bed after the baby vomited on him pleaded not guilty to third-degree homicide on Tuesday, according to media reports.

David Moyer, 24, of Trappe, Pa., entered the not guilty plea during his formal arraignment before Montgomery County Common Pleas Court Judge William R. Carpenter, according to a story in the Mercury newspaper.

He also reportedly pleaded not guilty to charges of endangering the welfare of a child and recklessly endangering another person.

Online court records in the case did not yet reflect the status of the formal arraignment.

Patch reached out to the Montgomery County District Attorney's Office to try and get independent confirmation of the guilty pleas.

Moyer had been ordered this summer to stand trial on the criminal charges following his preliminary arraignment.

Moyer, who was being held on $1 million bail since his arrest this spring, is accused of placing his baby son face down on a bed after the baby vomited on him, according to prosecutors.

Medical examiners subsequently determined that the child had died from blunt impact injuries, ruling the manner of death homicide.

Court records show that a miscellaneous hearing has been scheduled for Jan. 13, but it was not immediately clear what the hearing was going to be addressing.

A trial date for the matter has been scheduled for March.
