A Man Guilty Of Raping An Upper Moreland Woman Two Years Ago Is Heading To State Prison
Brian David Kelly Jr., 36, will spend between 69 & 138 months in prison in connection with his raping a former girlfriend in Upper Moreland.
UPPER MORELAND, PA — A city man who pleaded guilty back in October to charges that he broke into an ex-girlfriend's home and forcibly raped her is heading to state prison.
Brian David Kelly, Jr., of the Morrell Park section of Northeast Philadelphia, was handed down a sentence of between 69 months and 138 months in state prison in connection with the March 2020 rape in Upper Moreland Township.
Kelly was also given three years of probation upon his release, according to court records.

Kelly was sentenced on Tuesday by Montgomery County Common Pleas Court Judge Thomas C. Branca.
Patch previously reported on the case, in which Kelly had been arrested for breaking into his ex-girlfriend's Upper Moreland home and sexually assaulting her. The incident occurred in late March 2018 at around 2:30 a.m. at the victim's home.

The victim had said she broke off the relationship with Kelly in December 2019 but that he continued to harass her for months after, prosecutors stated.
On the day of the rape, Kelly used a ladder to enter the woman's home and, once inside, he sexually assaulted her, Montgomery County prosecutors previously stated.
This past October Kelly pleaded guilty to felony-grade rape by forcible compulsion, court records show. Other criminal charges had been dropped in exchange for the guilty plea.
