During the ensuing traffic stop, police asked Mitchell if he was OK. According to police, Mitchell told them that the Mustang was his brother’s car and there was something wrong with it.

Police said that while talking to Mitchell, he smelled strongly of alcohol. Police asked him to consent to field sobriety tests, and noticed that he almost fell out of his car while trying to exit it.

According to police, during the field sobriety tests Mitchell told them, “I can’t believe you are doing this to me. I know a lot of people in this town.” Police said Mitchell failed the tests, and he was arrested.

Police said that at headquarters, Mitchell made a confidential phone call at 8:01 p.m. When asked if he wanted to take a breath test, Mitchell allegedly told police that he had to speak with his attorney first.

Police said they gave Mitchell permission to make another phone call, but he refused. According to police, Mitchell told them he had lived in this town for 40 years, and he wanted police to call his mother. Police said Mitchell continued to argue with them and refused to consent to a chemical test as a result.

Police said a background check revealed that Fahey’s license was suspended, and also the warrant out for his arrest. He was arrested without incident.
