Police said that when talking to the driver, Marchetti, they could smell burnt marijuana. When asked about the marijuana, Marchetti said that there might be a burnt roach in the ashtray, and then continued to say that maybe there were four or five burnt roaches in the ashtray, but that there was no more marijuana in the truck.

Marchetti also told police that he was a registered Level One sex offender, and that he was on probation for the charge. A search of the truck revealed a small sandwich baggie of marijuana in the front center console.
