South Kingstown Man Arrested in Dispute Over Brother’s X-Box

Derek N. Benoit, 26, of 44 King’s Ridge Road, South Kingstown, was arrested at about 9:42 p.m. on Aug. 21 and charged with domestic vandalism.

According to police, at about 3:12 p.m. on Aug. 9 police received a report from a 23-year-old Narragansett man on Wanda Street that Benoit had broken his window.

The caller, a brother of Benoit, told police that Benoit showed up and demanded his X-Box back. The caller told Benoit that he did not have it there, and Benoit told him that he would be back later then.

According to police, the man told them that Benoit came back a short time later, made three knocks on his bedroom window, and then broke the window before fleeing the scene. Based on the statement, a warrant was issued for Benoit’s arrest.

Police said that at 6:15 p.m., Benoit called Narragansett police and admitted to breaking the window. Police asked him to turn himself in, but he refused, and told them he was staying at a friend’s in West Warwick. He also told police that he needed to contact his lawyer first.

Narragansett police said they notified West Warwick police of Benoit’s presence, and the warrant out for his arrest. However, Benoit was not arrested until Aug. 21, and by North Kingstown police. Details of his arrest were unavailable.

Narragansett police said that at about 12:35 a.m. on Aug. 22, a woman came with $250 for Benoit’s bail. A no-contact order was issued between Benoit and his brother, and he was released with an Aug. 30 date in Fourth Division District Court.

Massachusetts Man Arrested for DWI, Marijuana

Shawn J. Joia, 30, of 14 Maple Ave., East Foxborough, MA, was arrested at about 12:43 a.m. on Aug. 21 and charged with driving while intoxicated, refusing to submit to a chemical test, possession of marijuana and driving in possession of a controlled substance.

According to police, a dispatcher received a report from a community service officer that a tire with a flat had pulled into the parking lot of the town beach’s South Pavilion. An officer responded to assist.

However, the officer said that the driver, Joia, appeared to be intoxicated. Police said that Joia first claimed to have hit a pothole on Beach Street. When an officer told him that there weren’t any potholes on Beach Street, police said Joia put his head between his legs and looked down at the sidewalk.

Police said that Joia at first claimed to be at a wedding ceremony, and that he hadn’t been drinking. Police noted that in Joia’s car was a six-pack of New Castle beer, and one beer was empty. When asked again about whether he had been drinking, police said Joia admitted that he had.

According to police, they interviewed the CSOs who had first reported Joia. They told police that Joia’s car had been swerving on Boston Neck Road, and that while he was inspecting his flat tire, he couldn’t maintain his balance and stumbled.

Police said that Joia failed the first two aspects of a field sobriety test, and then refused to continue with the test. He was arrested at that time on a charge of driving while intoxicated. At police headquarters, Joia refused to submit to a chemical test.

According to police, in addition to the empty beer bottle they also found empty nips of Jim Bean whiskey and UV vodka in Joia’s car. Police said in the center console of Joia’s car was a pipe and a black jar of marijuana.

Police said that after booking Joia, they also received a report from a tow truck driver. According to a dispatcher, the driver told them that he saw a truck matching the description of Joia’s vehicle swerving before striking the center median on Beach Street.

According to police, during an interview conducted with Joia at 6 a.m., he admitted to drinking about five beers between 5 p.m. and 7 p.m. He told them that he was leaving Narragansett and on his way home to Foxborough.
