The officer said it took several knocks for DeCataldo to wake up and look in his direction. Police noted that the car smelled of alcohol, but DeCataldo denied having anything to drink that night.
Police said when they asked him where he was going, DeCataldo said he was heading home, waiting for the light to turn green so he could get turn onto Route 95 South. When he was informed that the light had already cycled through twice, police said DeCataldo refused to say anything in reply.
When asked by another officer if he had had anything to drink, DeCataldo allegedly said, “I don’t want to lie, I had about three drinks tonight.” Police said DeCataldo failed field sobriety tests, and refused to submit to both a preliminary breath test and a chemical test.
Police arrested DeCataldo and charged him with driving while intoxicated. He was cited for refusing to submit to a chemical test, refusal to submit to a preliminary breath test and stopping on a traveled portion of the highway.
Police noted that a search of DeCataldo’s car also revealed a fake Pennsylvania driver’s license.
According to online court records, DeCataldo pleaded no contest to a Richmond police charge of reckless driving in May 2011. This charge was amended from driving while intoxicated.
The arrest on March 13 triggered a review of the plea, and DeCataldo was charged as a two-time offender of the drunken driving statute.
According to court records, he pleaded no contest to the Narragansett police charge on March 14 and was ordered to pay a fine and court costs, to surrender his license for six months, and to complete 10 hours community service and DWI school.
