Lexington Man Charged With DUI Released From Jail

A Lexington man accused of hitting and killing a man walking on Lake Murray Boulevard on Jan. 6 is out of jail about a week after a judge denied his bond.

A judge denied his bond the following day, according to Lexington County court records. Smith stayed in jail for three days.

He was released Thursday on a bond of $250,000, after a Lexington County circuit court judge ruled that the bond amount was appropriate, according to the records. Conditions of his release require that Smith not have any contact with the family of the victim and submit to random drug tests, according to the report. Smith also has to stay within a 60-mile radius of Columbia.Â
When Irmo Police arrived at the scene of the collision, the victim, Geiger, was unresponsive and not breathing, according to the incident report. Smith told the officers he was a physician and could check the victim's pulse. The officers asked Smith to step away from the victim.

Smith is employed as a doctor at Lexington Family Practice on Polo Road, according to the S.C. Department of Labor, Licensing and Regulation.
When officers asked Smith what happened, he told them, "I was swerving. I blacked out, like narcolepsy, and was trying to get home," according to the incident report. Smith also told officers he had not been drinking.Â
Officers noticed that Smith's speech was slurred and that his eyes were "bloodshot, watery and droopy," according to the report.Â
Based on his slurred speech and poor performance on several field sobriety tests, officers arrested Smith for felony DUI, according to the report. A breath test showed a blood-alcohol level of zero percent.
Officers took Smith to Lexington Medical Center for drug testing, according to the report. The results of those tests have not been made public.Â
