Heritage Square Owner Takes Fight to Appeals Court
Circuit Court judge denies motion to reconsider.

The owner of a dilapidated and condemned shopping center has taken the fight to keep from demolishing the building to the S.C. Court of Appeals.
Heritage Square, at the corner of Highway 78 and Berlin G. Myers Parkway, has stood mostly vacant for decades. The Town of Summerville condemned the property, owned by Heritage Square Shopping Center LLC, in February 2010 after officials found the structure to be a hazard.Â
Earlier this week, Circuit Court Judge Maite Murphy denied the company's motion to reconsider — something the company had asked for twice after Murphy ruled that the company needed to submit demolition plans. Heritage Square filed a notice of intent to appeal with the S.C. Court of Appeals Thursday, according to Summerville Town attorney G.W. Parker.Â

The Court of Appeals is an intermediary court between Circuit Court and the S.C. Supreme Court. Cases can be later appealed to the Supreme Court out of Appeals Court.
