Kicking Police Officer Lands 32-Year-Old Man In Jail: ACPD

Arlington County Police arrested a man who they say kicked an officer when they were taking him into custody Saturday in Ballston.

FAIRFAX CITY, VA — A 34-year-old man who kicked an Arlington County Police officer on Saturday night in Ballston is facing multiple charges, according to authorities.

Officers responded around 8:19 p.m. to the 1100 block of North Street to investigate the report of a breaking and entering incident. A preliminary investigation revealed that a man had gained entry to the victims' vacant property without their permission, according to police. When the victims went to contact police, the man fled the area.

After a lookout was broadcast, the officers located a man matching the description of the suspect in in the area of Washington Boulevard and North Stafford Street, according to the incident report. As the officers took the man into custody, the suspect kicked an officer, who did not suffer any injuries.

Police charged Cyrus Ariavand of an undetermined address with assault on police and unlawful entry, according to ACPD. He was then held without bond.

Ariavand was arraigned on Monday morning in Arlington General District Court and had a bond hearing scheduled for 9 a.m. on Tuesday. As of Tuesday afternoon, he remained in custody, according to court records. A preliminary hearing was set for Oct. 14.

If convicted of the assault on police officer charge, which is a Class 6 felony, Arivand faces a possible sentence of one to five years in prison, or up to 12 months in jail and/or a fine of up to $2,500, according to the Code of Virginia. The breaking and entering charge is a Class 1 misdemeanor, which is punishable by up to 12 months in jail, a fine of up to $2,500, or both.

Ariavand already has a hearing in Arlington General District Court scheduled for Sept. 11 in connection to a June 2 arrest on public intoxication and trespass after forbidden charges, according to court records. Both charges are misdemeanors.
