Arlington Man Indicted For Re-Entering U.S. Following 2012 Removal

ICE became aware of a previously deported man being in the U.S. after he was arrested in Fairfax County in August.

ALEXANDRIA, VA — A federal grand jury in Alexandria indicted an Arlington man last Thursday for illegal reentry after removal from the U.S., according to court documents.

In an afidavit filed Sept. 25 in the U.S. District Court for Eastern Virginia, a deportation officer with U.S. Customs and Enforcement reported that Irvin Baadimir Marroquin, who had previously been deported from the U.S., had been arrested Aug. 15 in Fairfax County.

Fairfax police charged Marroquin with assault and battery of a family member and strangulation causing injury in connection to an incident that took place on July 4, according to court documents.

On Aug. 22, Marroquin was arraigned in Fairfax County Juvenile and Domestic Relations Court and had an adjudicatory hearing on Sept. 22, according to court records. He has a status hearing scheduled for 3 p.m. on March 19, 2026. He was released on bail.

The strangulation charge is a Class 6 felony, which carries a potential sentence of one to five years in prison or up to 12 months in jain and/or a fine of up to $2,550, under the Code of Virginia.

After reviewing court records, the deportation officer determined that Marroquin was a native and citizen of El Salvador, who was removed from the U.S. on Dec. 18, 2012 at or near Alexandria, Louisiana. The officer could find no evidence that Marroquin had documentation giving him legal status in the U.S.

On Nov. 18, Marroquin was arrested and a temporary detention order was signed by U.S. Magistrate Judge William B. Porter, according to court records.

A preliminary hearing was held on Nov. 20 and the court found that there was sufficient probable cause to move forward with the case. Marroquin was remanded to the custody of the U.S. Marshal's Service.

Marroquin is scheduled to be arraigned in the Alexandria Courtroom at 10 a.m. on Thursday on the illegal reentry after removal charge.

In order to convict Marroquin, the government needs to prove that he was a an alien, was previously removed, and that he knowingly re-entered the U.S. without authorization.
