23 Violations Found At This Fredericksburg Restaurant: Inspections

Most of the Fredericksburg food establishments inspectors visited between Jan. 2-6 had no violations, but one had 23, health reports say.

FREDERICKSBURG, VA — On the one hand, only four the of the 11 food establishments that Rappahannock Area Health District inspectors visited between Jan. 2-6 did not have any health code violations. On the other hand, one of the four restaurants where violations were reported had a total of 23.

Violations at Cowboy Jack's at 2312 Plank Road in Fredericksburg ranged from not having a certified food protection manager on staff and food being kept at the wrong temperature to an employee eating in the dishwashing area and numerous insects flying in the kitchen.

Observations & Corrective Actions

  • Absence of active managerial control observed during the inspection. The person in charge is not monitoring the following: 1. Cold holding temperatures of TCS foods. 2. Adequate separation of raw animal foods from ready-to-eat foods. 3. Eating in the kitchen by staff 4. Cleaning of food contact equipment.
  • The facility does not have an employee in a supervisory or management position that is a certified food protection manager. Through discussion the kitchen manager is in the process of obtaining his certification.
  • Observed an employee eating by the warewashing area. Discussed staff eating in the dining room to prevent contamination.
  • Observed an employee begin to lather their hands at the 3-compartment sink. Instructed the employee to wash their hands in a designated handwashing sink.
  • Observed white growth on cut tomatoes in the 4-door reach in cooler. During the inspection an employee voluntarily discarded the tomatoes.
  • Observed a box of shell eggs stored over an open box of whole lemons in the walk-in cooler. During the inspection the eggs and lemons were relocated.
  • Observed the only immersion blender soiled to the sight. Clean and sanitize prior to next use.
  • Observed heavily soiled char broiler. Inspection conducted upon opening and was not in use upon arrival.
  • Observed counter mounted can opened soiled, the person in charge reported the can opener was not used today. The can opener was removed to the 3 compartment sink for cleaning.
  • Observed interior of microwave ovens soiled.
  • Observed the following TCS foods improperly cold holding in the 3-door reach in cooler/prep cooler: 1. 3-4 packages of individual serving of macaroni and cheese - 51, 51 degrees F 2. Cooked, proportioned bags of cooked brisket - 45, 46 degrees F 3.Cooked, proportioned bags of cooked chicken - 47, 48 degrees F 4. Proportioned bags of mashed potatoes - 47, 47 degrees F 5.Proportioned bags of cooked carrots - 48, 48 degrees F 6. Proportioned bags of rice - 47, 47 degrees F 7. Bag of cooked brussel sprouts - 47, 48 degrees F 8. Sliced cheese (top of unit) - 48, 47 degrees F 9. Cooked pork sausage (top of unit) - 54 degrees F Based on discussion with the persons in charge the sliced cheese and pork sausage were pulled from the walk-in cooler at 10:00 a.m. and relocated to the walk-in cooler to cool to 41 degrees F or less by 2:00 p.m. All foods placed in the top of the unit at 10:00 a.m. were relocated to the walk-in cooler. All other foods were held in the unit overnight and were voluntarily discarded. Instructed the person in charge to discontinue cold holding of TCS foods until serviced by a technician. Discussed use of ice in food grade bags and monitoring temperatures.
  • Observed improper disclosure on the brunch menu, asterisk is placed next to the menu description. Relocate asterisk to the animal derived food which may be ordered/served raw and/or undercooked (eggs, steak).
  • Observed 4-6 thawed packages of salmon in their reduced oxygen packaging. During the inspection the salmon was voluntarily discarded for safety. Discussed cutting the package prior to thawing in refrigeration.
  • Observed fly paper over the back food preparation area which was removed during the inspection.
  • Observed numerous flying insects on multiple fly paper strips and insect control device.
  • Observed employees preparing food wearing wrist jewelry and rings other than a plan wedding band.
  • Observed employees without proper hair restraints preparing food and around exposed foods.
  • The following equipment requires sealing to the adjacent walls: 1. Stainless steel plate by the beverage station. 2. Prep sink
  • Observed accumulation of debris on nonfood contact surfaces throughout the facility including exterior of cooking equipment, wheels of movable equipment, reach in refrigeration units and shelving throughout.
  • Observed a long hose with spray nozzle connected to a water line by the cook line in absence of a backflow prevention device. Through discussion with a food employee, the hose is used to clean floors. A backflow prevention device is required. Instructed the employee to remove the hose which was not completed during the inspection. Emailed backflow prevention handout.
  • Observed accumulation of refuse around the dumpster.
  • Observed the floors under the 3 vat sink and dishwasher equipment is not smooth or easily cleanable.
  • Observed cleaning needed in the following areas: Exterior of light covers, walls (including behind the cook line), ceiling tiles and caulking in the warewashing area.

  • The handwashing sink is also being used as a dump sink and to rinse out the blenders. Corrective Actions: Use the small dump sink for the blenders or switch and use the small sink for handwashing.
  • The food employees were not wearing hair restraints.
  • Observed the following non-food contact surfaces soiled: 1) the inside bottom of the reach-in cooler; 2) the outside of the reach-in cooler; and 3) the inside of the deep freezer.
  • The walk-in cooler that is being used as a dry storage area has no light inside. It was 3.3-0 foot candles from the front to the back of the unit. Corrective Actions: I recommend putting a battery-operated lantern or some other type of light source in the unit so that employees can see what is in the unit.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation.Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
