French Fries Left Out Too Long At Fredericksburg Restaurant: Report
Rappahannock Area Health District inspectors found health code violations at 16 of the 20 restaurants they visited recently.
FREDERICKSBURG, VA — Inspectors from the Rappahannock Area Health District reported violations at 16 of the 20 food establishments they visited between Jan. 27 and Feb. 7.
Violations ranged from unclean work surfaces to a dumpster not having a lid on it. At one restaurant, an inspector reported finding french fries being held for up to two hours without temperature control or written procedures.
“If time without temperature control is used as the public health control up to a maximum of four hours the food shall be marked or otherwise identified to indicate the time that is four hours past the point in time when the food is removed from temperature control,” the inspector wrote in their report. They also left written instructions with the person in charge.

- Observed the interior of the microwave (front of the house) in need of cleaning. Corrective Actions: The cavities and door seals of microwave ovens shall be cleaned at least every 24 hours by using the manufacturer's recommended cleaning procedure.
- Observed the chlorine santizer in a wiping cloth bucket used on food contact surfaces at a concentration over 200 ppm. Sanitizer was remade to the proper concentration. Corrective Actions: Chemical sanitizers, including chemical sanitizing solutions generated on site, and other chemical antimicrobials applied to food-contact surfaces shall: 1. Meet the requirements specified in 40 CFR 180.940. 2. Meet the requirements as specified in 40 CFR 180.2020.
- Observed the chlorine test strips expired. Corrective Actions: A test kit or other device that accurately measures the concentration in mg/L (ppm) of sanitizing solutions shall be provided and readily accessible for use.
- Observed the following non food contact surfaces in need of cleaning: shelving throughout, interior of reach in freezer (back of the house) and reach in cooler (front of the house), and storage containers throughout. Corrective Actions: Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues.
- Observed the floors throughout the kitcken in need of cleaning. Corrective Actions: The physical facilities shall be cleaned as often as necessary to keep them clean.

- Observed a chemical spray bottle stored over clean dishes. Spray bottle was relocated. Corrective Actions: Poisonous or toxic materials shall be stored so they cannot contaminate food, equipment, utensils, linens, and single-service and single-use articles by: 1. Separating the poisonous or toxic materials by spacing or partitioning.

- Observed the inside of the microwaves soiled. Through discussion with the person in charge utensils are being cleaned (wash/rinse/sanitize) at night and only sanitized during the day.
- Observed the following time/temperature control for safety (TCS) foods cold holding above 41°F: In the one-door prep cooler there was one medium sized plastic pan of portioned lobster bisque butter (lobster and butter) at 44-45°F item was in the unit overnight (unit at 40°F); In the one-door two-drawer prep cooler there was one small stainless-steel pan of ranch at 43°F and one small stainless-steel pan of bleu cheese dressing at 44°F items were in the unit overnight (unit at 35°F). Corrective Actions: All TCS foods were voluntarily discarded.
- Time is being used for the tempura flour, batter, and buttermilk. The person in charge was unable to provide documentation for using time as a public health control. There were stickers with the time displayed on them (prep and discard times). Corrective Actions: Time as public health control document will be filled out and signed by person in charge and Environmental Health Specialist (EHS). A copy will stay at the facility and one copy will be put in the file for the facility.
- Fifteen pieces of trout in reduced oxygen packaging were thawed (35°F) without the package being opened or cut to allow oxygen in. Corrective Actions: The trout was voluntarily discarded.
- Observed what appeared to be rodent droppings in the corner of the storage area where the drink syrups are stored. The person in charge was unable to provide a temperature measuring device (irreversible registering temperature indicator) for the high temperature dish machine.
- Observed the following non-food contact surfaces soiled: 1) the floor of the walk-in freezer; 2) the outside of coolers and freezers; 3) the outside of the microwaves; 4) the inside of the prep coolers (doors and bottom); 5) the up splash of the drink dispenser; 6) the top of the ice bin in front of the drink dispenser; 7) shelving throughout the facility; 8) the vents near the staff toilet room; and 9) there is heavy carbon build up on the sheet pans and some of the pots.
- The mop sink has a bell cap backflow device, but no dual-check valve. There is a y-connector with a hose and sprayer attached to one end and the water is constantly running. Corrective Actions: Obtain a dual-check valve and place it between the y-connector and hose with sprayer. The water was turned off for now. I recommend removing the hose until the backflow device is connected.
- The floors throughout the facility, including under and behind equipment, are heavily soiled.

- The irreversible registering temperature indicator showed a temperature of 148.7°F. The gauges did not move from 150°F (wash) and 130°F (rinse). Dishes are not being properly sanitized since the minimum temperature of 160°F was not reached. Corrective Actions: The person in charge will have Eco Lab correct the issue. Until it is fixed the 3-compartment sink will be used to sanitize all dishes.
- The person in charge was unable to provide an irreversible registering temperature indicator.

- Observed the following foods inside the reach-in cooler at improper temperatures : 1. Cheese tortellini prepared on 1/25 at 45 degrees 2. Beef vegetable soup prepared on 1/26 at 46 degrees 3. Deli turkey prepared on 1/25 at 44 degrees During the inspection the person in charge voluntary discarded all foods .
- Observed inside the reach-in cooler a container of pre-cooked pulled pork labeled 1/7. Through discussion with the person in charge the pork was prepared on 1/7. Food was was discarded during the inspection.
- Observed six cutting broads heavily scored and stained.
- Observed the following non food contact surfaces in need of cleaning : 1. Shelving inside walk-in cooler 2. Upsplash of table mixer 3. Exterior of all cooking equipment
- Observed a long hose connected to the facuet of the mob sink laying inside the basin of the mob sink .During the inspection the hose was disconnected and removed .

- Observed the following foods being held in the front True two-door cooler above 41°F: 1) 2% milk at 43°F; 2) fruit cup at 45°F; and 3) sandwich at 45°F. The 2% milk in the walk-in cooler (delivered an hour before) was holding at 44°F. Corrective Actions: The TCS foods in the True reach-in cooler were relocated to the walk-in freezer to be cooled quickly. The delivered 2% milk was relocated to the walk-in freezer, it was at 34°F after about 30 minutes.
- Time as a public health control (TPHC) is being used for the half and half, 2% milk, and oat milk in the customer self service area (half & half 47°F, 2% milk 48°F, oat milk 52°F). The person in charge was unable to provide documentation for TPHC. Corrective Actions: TPHC documentation will be signed and the time of preparation and time to discarded will be posted in the area where the milks are kept.
- The outside of equipment throughout the kitchen and the holder for the bar drink nozzle are soiled.
- The ceiling and floors throughout the kitchen are soiled.

- Observed no soap at the front hand sink. PIC placed hand soap at the sink. Corrective Actions: Each handwashing sink or group of two adjacent handwashing sinks shall be provided with a supply of hand cleaning liquid, powder, or bar soap.
- Observed the sanitizer in the in-use 3comp sink at 0ppm when tested. Sanitzer was remade to the proper concentration. Corrective Actions: Utensils and food-contact surfaces of equipment shall be sanitized before use after cleaning.
- Observed two containers of meatballs (105 and 115 degrees F) in the hot holding unit held at improper temperatures. Temperature of the unit was on the lowest mode and was turned high. The food was in the unit for 3.5 hours and had 30 minutes to be brought up to temperature. PIC reheated meatballs to 165 degrees F. Corrective Actions: Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under 12VAC5-421-850 and except as specified in subsections B and C of this section, time/temperature control for safety food shall be maintained: At 135°F (57°C) or above, except that roasts cooked to a temperature and for a time specified under 12VAC5-421-700 B or reheated as specified in 12VAC5-421-760 E may be held at a temperature of 130°F (54°C) or above.
- Observed food employees not wearing hair restraints. Corrective Actions: food employees shall wear hair restraints, such as hats, hair coverings or nets, beard restraints, and clothing that covers body hair, that are designed and worn to effectively keep their hair from contacting exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles.
- Observed the following non-food contact surfaces in need of cleaning: 1) interior and exterior of all equipment. 2) shelving throughout. 3) upsplash of the soda machine. Corrective Actions: Except when dry cleaning methods are used as specified under12VAC5-421-1810, surfaces of utensils and equipment contacting food that is not time/temperature control for safety food shall be cleaned at a frequency specified by the manufacturer or absent manufacturer specifications, at a frequency necessary to preclude accumulation of soil or mold. To include equipment such as ice bins and beverage dispensing nozzles and enclosed components of equipment such as ice makers, cooking oil storage tanks and distribution lines, beverage and syrup dispensing lines or tubes, coffee bean grinders, and water vending equipment.
- During discussion with the person in charge, it was discovered that in-use utensils are only cleaning in-use utensils every 5 hours. Corrective Actions: Equipment food-contact surfaces and utensils shall be cleaned throughout the day at least every four hours.
- Observed that the shake mix in the cooler below the shake machine was cold-holding at improper temperature (44'F). Shake mix was relocated to the walk in cooler and the temperature of the unit was lowered during inspection. Corrective Actions: Temperature controlled for safety foods must be cold held at 41'F or less.
- Observed french fries being held up to two hours without temperature control without written procedures. Left written procedures with the person in charge. Corrective Actions: If time without temperature control is used as the public health control up to a maximum of four hours the food shall be marked or otherwise identified to indicate the time that is four hours past the point in time when the food is removed from temperature control.
- The dumpster behind the establishment is missing a lid. Corrective Actions: Storage areas, enclosures, and receptacles for refuse, recyclables, and returnables shall be maintained in good repair.

- The time/temperature control for safety (TCS) foods in the sandwich prep cooler are held above 41ºF (hot dogs 49ºF, Chicken strips 48ºF, Sliced tomatoes 52ºF, shredded lettuce 55ºF). The health department was not informed that time is being used instead of keeping the TCS foods at 41ºF or below.
- Time as a public health control is currently being used for the TCS items in the sandwich prep cooler. The unit is not working properly. The items were not marked with the time that they were placed in the unit or when they need to be discarded. Corrective Actions: The times were marked on the unit. The unit needs to be repaired so that the foods are maintained at 41ºF or below.
- The following equipment is in need of repair: 1) the lid on the raw hamburger prep cooler is damaged; 2) there is a leak under the three-compartment sink; 3) the sandwich prep cooler is reading at 44ºF with the food temperatures reading at a 48-55ºF (it hasn't been holding the proper temperature for about a month). Corrective Actions: There is a work order in for the three-compartment sink leak. The prep coolers need to be repaired as soon as possible.
- The following non-food contact surfaces are soiled: 1) the up splash of the drink dispenser in the customer area; 2) the outside of the nacho cheese dispenser; and 3) the air diffuser and vent above the sandwich prep cooler.

- Observed caulking at the 3 vat sink and ceiling tiles in need of cleaning. Observed dust accumulation on ceiling tiles around air vents. Corrective Actions: The physical facilities shall be cleaned as often as necessary to keep them clean.
- Observed damaged ceiling tiles (tears, gaps and/or holes) in ceiling tiles in the back of the house and paint is peeling on the walls in the female toilet room near the handwashing sink. Corrective Actions: The physical facilities shall be maintained in good repair.
- Observed dust accumulation on air vents in the facility. Corrective Actions: Intake and exhaust air ducts shall be cleaned and filters changed so they are not a source of contamination by dust, dirt, and other materials.

What Violations Do VDH Inspectors Report?
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.
Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
