Tortilla Shells Handled With Dirty Gloves: Fredericksburg Inspections

Rappahannock Area Health District inspectors reported finding violations at seven Fredericksburg food establishments between Jan. 15-23.

FREDERICKSBURG, VA — Between Jan. 15 and Jan. 23, Rappahannock Area Health District inspectors visited 15 food establishments in Fredericksburg, finding violations at seven of them.

At one restaurant kitchen, an inspector observed a food employee who was wearing gloves touch the buttons on the fryers and door handles of the reach-in freezer. The employee then began handling tortilla shells without changing their gloves and washing their hands.

The inspector explained proper glove use to the employee, who then removed their gloves, washed their hands and donned a new set of gloves before handling food.

  • The walk-in freezer has heavy icing in the back under the fans, but it is still maintaining the temperature (12°F). Also, the dish machine is currently not working.Corrective Actions: A repair person has already been called for the walk-in freezer. Recommend relocating all food from under the fans in the walk-in freezer until it can be repaired. The 3-compartment sink is being used to wash/rinse/sanitize all dishes.

  • Observed a long hose attached to a spray nozzle attached to the mop sink, without correct backflow prevention. The mop sink had a vacuum breaker, however, a dual check valve is required for continuous pressure. Spray nozzle was removed removed during the inspection. EHS provided a handout to the person in charge and requsted once the backflow preventer is installed to email EHS a picture.

  • Observed a can of WD40 on top of the soda fountain . During the inspection the WD40 was relocated .
  • A Observed numerous ceiling tiles throughout the facility and one ceiling air vent missed placed.
  • Observed the following non food contact surfaces in need of cleaning: 1. Exterior of bulk food containers 2. POS moniors 3.Exterior of all cooking equipment 4. Exterior of syrup bottles 5. Shelving
  • Observed a long black hose connected to the mob sink leaking water with a spray nozzel attached while absent of a dual check backflow preventer . During the inspection the person in charge turned the water off and removed the spray nozzel . EHS discussed with the person in charge not using the spray nozzel until the dual check backflow preventer is installed. EHS provided a hanout to the person in charge and requsted they email a picture once the backflow preventer is installed.
  • A Observed walls ,ceilings and floors (including floors drains ) are in need of cleaning.
  • Observed the following employees personal belongings improperly stored: 1. Purse on top of a cutting broad below prep table 2. Two purses on a box of ketchup on the dry storage shelf During the inspection the purses were relocated.

  • Observed an employee with a beard preparing food without a beard guard. Corrective Actions: A. Except as provided under subsection B of this section, food employees shall wear hair restraints, such as hats, hair coverings or nets, beard restraints, and clothing that covers body hair, that are designed and worn to effectively keep their hair from contacting exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles. B. This section does not apply to food employees such as counter staff who only serve beverages and wrapped or packaged foods, hostesses, and wait staff if they present a minimal risk of contaminating exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles.
  • Observed several line storage pamd stacked while wet. Pans were separated during inspection Corrective Actions: After cleaning and sanitizing, equipment and utensils: 1. Shall be air dried or used after adequate draining as specified in 40 CFR 180.940 before contact with food; and 2. Shall not be cloth dried except that utensils that have been air-dried may be polished with cloths that are maintained clean and dry.
  • The door gaskets on two of undercounter reach in coolers are torn. Corrective Actions: A. Equipment shall be maintained in a state of repair and condition that meets the requirements specified under Articles 1 (12VAC5-421-960 et seq.) and 2 (12VAC5-421-1080 et seq.) of this part. Unused or non-functioning equipment shall be removed from the premises. B. Equipment components such as doors, seals, hinges, fasteners, and kick plates shall be kept intact, tight, and adjusted in accordance with manufacturer's specifications. C. Cutting or piercing parts of can openers shall be kept sharp to minimize the creation of metal fragments that can contaminate food when the container is opened.
  • The floors in the walk in cooler are in need of cleaning. Corrective Actions: The physical facilities shall be cleaned as often as necessary to keep them clean.
  • The hand sink in the men restroom is coming loose from the wall. Corrective Actions: The physical facilities shall be maintained in good repair.

What Violations Do VDH Inspectors Report?

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation.Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.

The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
