Waukesha Gas Station Fights Rivals' Claim Its Fuel Is Too Cheap

Despite record high prices at the pump, a lawsuit accuses Woodman's of pricing its fuel too low.

WAUKESHA, WI — A gas station selling fuel for an eye-popping $3.69 Wednesday is being sued by its competitors — which claim its prices are too low.

Woodman's asked a court to dismiss the lawsuit Tuesday as gas prices in Wisconsin soared to their highest level since 2011.

Gogo Petroleum, LLC and Super Four Corp. claimed that Woodman's sold gas below the legally required minimum price for 40 days and put them at a "competitive disadvantage," the Waukesha Freeman reported. The supermarket chain said it was allowed to sell gas below the legal minimum and asked a judge to rule on the case, according to the paper.

The two competitors filed to sue Woodman's on March 26, 2021, court records showed. Dates for a three-day jury trial are set for October 2022.

Gogo Petroleum owns the Shell gas station at 1635 E. Main St., which sold regular gas for $3.89 on Wednesday, according to GasBuddy. Super Four Corp owns the BP at 1610 Lincoln Avenue, which sold regular gas for $3.99.

Woodman's has the rest of the gas stations in Waukesha beat, charging $3.69 for a gallon of regular gas, according to GasBuddy.

That's 30 cents less than the average price for a gallon of gas both in the Milwaukee-Waukesha metro area and across the rest of Wisconsin. On Wednesday, the average price for a gallon of regular gas was $3.99 in the Badger State, according to AAA.
